CompTIA Sues Overseas 'Braindumper'


8/6/2003 -- According to court records, the Computing Technology Industry Association (CompTIA) is currently pursuing a copyright infringement case against CheatExams.com, a Web site that sells " real exam questions." The site's URL is registered to Adarsha Computers, which lists an address and phone number in Denmark.

CompTIA has pursued legal action against U.S. based braindump sites several times over the past few years, including a case in 2000 against the then-Texas based Troy Tech (click here, here and here for past coverage of this site) and another in 2001 against Cheet-Sheets. However, this appears to to be the first such suit filed against an overseas braindumper.

The civil copyright suit was originally filed in February in the U.S. District Court of Connecticut against a U.S.-based defendant named George Jennings. At the time, whois listed Jennings as the registrant for the URL.

Adarsha Computers, the current registrant, was added as a codefendant in May.

According to the case docket, neither defendant responded to the case, and CompTIA has asked the judge to grant it a summary judgment.

CertCities.com attempted to reach Adarsha Computers using the Denmark phone number listed, but received an out of service error. The e-mail address bounced. We also attempted to reach the site owners through the contact information given on CheatExams.com, but received no response. We were unable to verify the existence of Jennings.

According to AIRN.org, the IP address registered to the site is hosted in India. CertCities.com located an Adarsha Computer in India, but was unable to communicate with the company to find out if it has a connection to CheatExams.com. Adarsha appears to be a common naming convention for businesses and educational institutions in the country.

A spokesperson for CompTIA said that the organization could not respond to our request for comment by press time, but may be prepared to make a statement about the case shortly.

They are the ones who hurt this industry the most by taking money from people for passing a stupid multichoice paper exams. And they have the b***s to sue others. What a load of croc. I hope someone nails them too. I lost my $200 on this joke too.

8/19/03: Anonymous says: Sounds to me like CompTIA won't be around much longer. I have yet to see anyone express the real value of CompTIA exams. Anyone, anyone...I'm still waiting...need a value estimate here. Hmmm, CompTIA are you listening? Why don't you prove to us IT folks the real value of your tests in a competitive market. Then, and only then, should you have the right to sue. I will give out exam questions at a moments notice if I have a buddy who needs help. If I take the test and pass, I should have every right to "mentor" those who haven't taken the test yet. CompTIA ranks right up there with Brainbench tests when it comes to validity and worthiness; however, Brainbench tests are around $50 apiece vice over $200 for every CompTIA one. Later all and lets help to keep each other employed in the IT capacity.

8/27/03: Doug from Dallas says: Fellow techies, Remember that CompTIA is a member organization. Two of its larger members are MS and CISCO. So when CompTIA goes after these sites, in effect, so are MS and Cisco. I am all for it!
8/27/03: Bobby from Chicago area says: I am glad to see some of us in the Tech community taking a positive stand for ethics and quality. After all are we not competent? I only have a problem within and without the ethics of it all when any anonymous (or semi) person who makes claims and allegations doesn't appear to be very fit for the positions they claim (or, gods forbid, actually hold.) I Refer to grammatical and spelling errors. Grammar errors usually tell what ethnic group (or area) the poster is from based on the grammar of their native tounge.(or dialect) Or it could be just a plain lack of education, either way it undermines credibility of the statements made. "We are innately competent as reproduction machines, we must learn how to act as Humane beings." (knowing the difference between Human and Humane.)

I for that matter have had no problem with getting a job but believe my comptia certs helped. The company that I started working for was just getting up to 40 computers and was beginning and now we have over 70 in one year. They would have been lost without me. Anyways the pay was perfect per the Certs and the more experience that I am getting because I am the only one makes a hell of a difference toward getting my MCSE, MCSD, etc. Just because I have had to learn databases and a bit of programming, basics, basics, basics. If you don't have your basics in then how the hell do you expect to trully understand the foundation of something. I am glad that Comptia is around for us guys that did'nt go to college but got right into the job market of IT Professionals.
