BREAKING NEWS: "Braindump" Site Owner Sentenced


1/31/2003 -- Robert Keppel, the first "braindump" site owner to be criminally convicted for selling IT certification exam questions, was sentenced this morning in federal court to 12 months and 1 day in prison and ordered to pay $500,000 in restitution to Microsoft.

Judge Ronald Leighton in the United States District Court, Western District of Washington also ordered Keppel to three years supervised release after his prison term is served, and added a $100 "special assessment" that goes into the court's victim relief fund, a court spokesperson said.

Keppel pleaded guilty in August to a felony charge of theft of trade secrets in violation of Title 18, United States Code, Section 1832(a)(2), part of the Economic Espionage Act of 1996. The charges stemmed from the sale of Microsoft certification exam questions through Keppel's now-defunct Web sites, Cheet-Sheets.com and CheetSheets.com.

The U.S. Attorney's office had asked for an 18 month prison sentence for Keppel.

Keppel's defense attorney argued for work release or probation.

An independent attorney told CertCities.com that Keppel could serve as little as four months of his sentence, depending on factors such as "good behavior." The defense could also choose to petition the judge to reconsider the sentence.

CertCities.com is attempting to contact Microsoft and Keppel's defense attorney for reaction to this verdict.

The amount of restitution Keppel was ordered to pay is in addition to assets already forfeited by Keppel, including a 1997 Ferarri Spider, a 2001 Lexis RX300 and $56,000 seized from various bank accounts.

A spokesperson for the US Attorney's office told CertCities.com that the reason the sentence was 12 months and one day is that "[the sentence] needs to be over a year [for] a felony."

Robert Pedigo, Executive Director for the Information Technology Certification Security Council (ITCSC), an industry consortium that works to preserve the security of certification exams, said that the verdict is "good news for everyone who takes a certification test honestly and for those who create and deliver those tests. It's bad news for those who would try to profit by undermining the value of certifications."

"The members of the ITCSC [which includes Microsoft, Cisco, CompTIA, and others] believe that the important point is summed up by the conviction," he commented. "It demonstrates that the courts recognize the copyrights of intellectual property owners and that test theft and fraud in testing are now clearly criminal activities."  -B.N.

We are the little troops who do their dirty work - we study and train, and then we purchase and implement, beta-test and update. It's a perfectly deployed plan and we are all a part of it whether we like it or not. You see, it's a huge marketing device and we are all a part of it. How about some profit sharing, Microsoft?

2/25/03: It's all crap from Minnesota says: The reactions that you are seeing here are posted in hopes of justifying a lesser sentence, but for equity in laws and the marketplace. Refering to the braindump users and providors as 'criminals' and worse on this site is lame. While it is unethical, it isn't immoral and, in my opinion, not really criminal considering 1st ammendment rights and the proliferation of information sharing sites that exist out there. Plugging all the holes that exist and trying to stop all exam information from leaking out is impossible - it is a wasted effort unless you create a totalitarian society where all activity is monitored and regulated. This guy was prosecuted as an example, not as an act of justice. Your naive and self-rightouse attitude is lame. Why not write the exams proactively with a relevant basis (not ambigous and vague), create easier to use products that are better produced and beta-tested before they are released, create troubleshooting guides that are clear and concise along with training curriculum that isn't 'Microsoft Official Crap'! There is a lot that can be done to make braindump sites irrelevant rather waste resources on fruitless witch hunts. Get off your moral high horse 'Anonymous' and see the real issue.
2/28/03: Anonymous says: The need of the public to even know the question beforehand lies in the fact that the test questions themselves lean to misinterpretation or total "what the XOXO are they talking about" language. The entire test is geared for retest to increase the revenue of those who make and give the tests. If they asked a straight question practically no one would fail, hence their profits would go down. When you encounter a problem in the field how many end users have you encountered that speak in the 'test question' style? After 20 years I have yet to encounter 1.
3/3/03: Public not the problem says: "The general public who purchased exam guides from Braindump sites did so legally at the time of purchase. The exam guides were also copywrited by the distributers and sold as if they were legal content. Also the public who purchased the guides did not breach the non-disclosure agreement. If anything the people who purchased the guides did so thinking that it was legal to do so as neither Microsoft or law enforcement had announced that these sites were illegal until the recent court case and even then it is only illegal to sell or distribute the guides. Personally I'd like to see Microsoft bogged down for years in the courts trying to prosecute most likely hundreds of thousands of MCP's and IT employees who purchased guides in good faith or trying to penalise purchasers of guides as it would destroy the certification program altogether as a credible qualification. Obviously owners of websites that sell the guides committed fraud on the public by offering illegal content as legal exam study content. Many of these websites continue to sell the exam guides and only a small handfull have ceased operation."

3/3/03: Anonymous says: IT Certifications are a joke. Certifications are no indicator of someones ability to do an IT related job. I'd laugh at anyone who thinks otherwise. I for one have refused to get involved in any of that nonsense. I have a consulting company and have done quite well without them, and will continue to do so. As for the brain dumps....I don't see what is so different about those compared to the mock exams like Trancenders, Exam Essentials, etc., who also profit from those activities. Brain dumps, practice exams, and an endless stream of study material only exist because the test are so ambiguous to begin with. They don't test true knowledge of the topic. There's real world knowledge, and test knowledge needed to get the certifications. It a shame that someone could be very proficient in the real world and actually fail an exam because they didn't "study the test".
