Police Seize Assets of TestKiller.com


7/10/2002 -- On June 6 San Antonio police seized assets of TestKiller Ltd., the company that runs the practice exam Web site TestKiller.com.

According to a police report filed with the Bexar County, Texas District Court on June 20, the raid was prompted by Microsoft, who alleged that the site was selling Microsoft certification exam questions.

In his affidavit, seizing police officer Daniel Flaharty, a detective in the Special Crimes Unit of the San Antonio Police Department, wrote that he was contacted by a representative from the anti-piracy office of Microsoft. The unnamed representative alleged to Flaharty that TestKiller Ltd. was selling Microsoft "trade secrets" in the form of questions and answers to Microsoft exams.

According to the report, Flaharty began an investigation based on Microsoft's complaint, which led to the June 6 seizure of $408,566.84 in cash as well as several phones, printers, computer equipment, software and other items from at least one location.

No charges have been filed in this investigation. Calls made to the Bexar County district attorney's office to determine whether the investigation was ongoing were not returned as of press time.

Garry L. Neale, one of Testkiller Ltd.'s owners, politely declined CertCities.com's request for an interview, referring all questions to his attorney, who is out of the country this week.

A spokesperson for Microsoft confirmed that the company was aware of the investigation but said he could not comment on it due to the legal nature of the story.

The Testkiller.com Web site has been offline since early June.

Neale is the former owner of Troy Technologies (TroyTec.com), which in December settled a civil copyright and trademark infringement lawsuit brought by certification vendor CompTIA (see "CompTIA v. TroyTec Settled; Company Pulls CompTIA-Related Products from Site, Denies Wrongdoing").

9/24/02: Nash says: Most of my knowledge of Microsoft 2000, Exchange 2000, and ISA 2000 came from buying 2 or more third party books, usually at Barnes and Nobles. I think it sucks I spent $8000 on classes and ended up teaching myself. I wish I had of known that before so I could have saved the cash. I also wish I had of known about TestKiller.com.
9/27/02: Anonymous says: I feel that cerification are bad to begin with!!!! I curntly hold CNE, MCSE 4 and 2000, CCNA (CISCO) , ESE (ENTERASYS)and Compaq Master ASE SAN and HA. I don't feel that I am better at performing in these ares because of my certs but it helps me earn more money. It would be better if companes looked and my expeirence and spent more time interviewing their prospects. Some of the best engineers I know can't or will not pass the test. so they get weeded out before they get a chance. I would feel better if companies would have a real probation period. Contract the emp for 1 to 2 weeks then make an offer or not. I really feel that certs are couter productive but I'll keep getting new one and play the game.
9/30/02: Coldfire from NJ says: Ok, so all you people sit there and bitch about people not knowing anything. It's the employers fault for hiring these idiots in the first place. Would it kill an Interviewer to sit an interviewe down at a computer have them do the basic stuff? Like hey "Joe Smith have a seat & map a drive for me." or "Create a user" or anything else that would seem to be basic for the job.
10/1/02: Would you have cheese with your whine says: Quit acting like a bunch of girls that got stood up for the prom. Some of us techie die-hards don't have time to take tests or even study for them because we are working all the time... (bet most of the people on this board are techs on the shelf right now) This was one product that allowed us to get up to speed quickly.
10/7/02: anon from texas says: ya know. i agree that these type things devalue a truly earned cert but i tell you. i spent 15,000 dollars to attend a certified class at SMU in texas and after the first test found that the materials that microsoft supplied were severely short of preparing me for the test as stated. also, the class had no advancement testes or tests along the way to guage your learned skills retention. i was forced to seek troytec after realizing the shortcomings of the class once i was in debt for 15,000 ! i told myself that "i'll be damned if i am going to try this hard, do all the material and still not be prepared for testing and fail. if microsoft would get off it's ass and give the paying students what they thought they were paying for, all these places would be gone because prospective employers would be able to hone in on those students that went through the rigors and hands on necessary to know the position they are looking to fill.
10/8/02: anonymous says: Just another Way for Microsoft to make money, they can not make the money any other way so they charge steep prices. What happend to actual experience and not bookwork. I have not seen any questions from microsoft that actually happen, all different. What a scam
10/9/02: The Violator says: All of these people with their holier than thou attitudes forget that Microsoft got where it is my stealing, lying, cheating, and prevaricating (good business in my eyes--it happens all over the world everyday). More power to Microsoft. They are protecting their interests. But, don't be stupid and buy the hype. Individually, we must all use whatever resources are available to accomplish OUR goals. Troytecs are popular because they work ... at helping you pass the test. Being certified has nothing to do with being a tech. Being a tech has nothing to do with being certified.
10/9/02: The Violator says: We wouldn't even be having this conversation right now if Troytec had a glossy interface, pretty pictures, charged a couple of hundred bucks for a test prep package (with the same info but made it more confusing like Microsoft)AND . . . [insert drumroll here] gave a kickback to Microsoft, Comptia, or whoever.
10/9/02: Mephisto says: I agree with Violator. Everyone is arguing about legalities rather than the validity of the material in question. And as far as ethics go, there are none in business. And, certifications are big business. M$ doesn't care about you. They want that MONEY !!!
