Police Seize Assets of TestKiller.com


7/10/2002 -- On June 6 San Antonio police seized assets of TestKiller Ltd., the company that runs the practice exam Web site TestKiller.com.

According to a police report filed with the Bexar County, Texas District Court on June 20, the raid was prompted by Microsoft, who alleged that the site was selling Microsoft certification exam questions.

In his affidavit, seizing police officer Daniel Flaharty, a detective in the Special Crimes Unit of the San Antonio Police Department, wrote that he was contacted by a representative from the anti-piracy office of Microsoft. The unnamed representative alleged to Flaharty that TestKiller Ltd. was selling Microsoft "trade secrets" in the form of questions and answers to Microsoft exams.

According to the report, Flaharty began an investigation based on Microsoft's complaint, which led to the June 6 seizure of $408,566.84 in cash as well as several phones, printers, computer equipment, software and other items from at least one location.

No charges have been filed in this investigation. Calls made to the Bexar County district attorney's office to determine whether the investigation was ongoing were not returned as of press time.

Garry L. Neale, one of Testkiller Ltd.'s owners, politely declined CertCities.com's request for an interview, referring all questions to his attorney, who is out of the country this week.

A spokesperson for Microsoft confirmed that the company was aware of the investigation but said he could not comment on it due to the legal nature of the story.

The Testkiller.com Web site has been offline since early June.

Neale is the former owner of Troy Technologies (TroyTec.com), which in December settled a civil copyright and trademark infringement lawsuit brought by certification vendor CompTIA (see "CompTIA v. TroyTec Settled; Company Pulls CompTIA-Related Products from Site, Denies Wrongdoing").

7/26/02: Anonymous says: Testkiller (Troytec) was closed because of CompTIA. Microsoft doesn't care. Test King and MCSEBraindumps should be the next ones. I have seen Test King banners ads on this site. Techrepublic mentions MCSEBraindumps.com as a GREAT certification resource for Microsoft certifications in its employment kit (download). Is Techrepublic aware that MCSEBraindumps.com is a braindump site containing actual exam questions? Is CertCities aware that TestKing has a demo for the 70-218 (pdf file) that contain actual questions with exhibits and that they admit to sell the actual questions? How these sites and other got these questions? I personally notified Microsoft's MCP program about these sites 3 months ago. They said that they will investigate but these sites are still operating and have been online for long time. This is so strange. I do really believe that Microsoft doesn't care as long as they continue receiving money from these certifications. It is big business for them, training schools, tests prep vendors and book publishers. It is up to us to sponsor these certs and to spread the word that they don't have the value that used to have because anybody can pass these exams since you can get the actual questions from these sites. So the next time you are being told that you don't qualify for the job because you don't have your MCSE tell them about this because the industry needs to understand that this is about money and nothing else. Don't believe in Microsoft and training schools marketing campaigns. This certification madness is worthless these days.
7/26/02: Anonymous says: Microsoft is not doing a very good job protecting exams integrity. People is breaking the non disclosure agreement. HR and hiring managers are not aware of this or they are caught by vendor's marketing campaigns. Has anybody heard about a job posting requiring the new MCSA cert? I haven't seen any. According to CertCities, the MCSA is the hottest IT cert for 2002. This is marketing and nothing else. Don't bite the dust.
7/26/02: Anonymous says: By the way, Transcender is also another one. I remember when I took the NT 4.0 Workstation exam, 85% of the questions that I saw in my test were word for word the same as in Transcender's test.

7/27/02: htm says: well, i sat an exam yesterday (doing msca).... & i'd read the testkiller cheat sheet for it the day before that my friend bought from testkiller.com. the exam was IDENTICAL to the cheat sheet. many questions were even word for word.
7/27/02: MCSE student says: I think this action by Microsoft was motivated more by copyright violations than by desire to enhance the validity of the test process. I wouldn't be surprised if the MS-authorized test prep companies pressured MS into closing down testkiller for siphoning off their potential revenue. If MS was really concerned about preserving the value of the test process they would have improved the testing procedures a long time ago. It seems like most of the posts here are either bashing cheaters or defending the "gaming" of the tests. What I do not understand is why the attention isn't directed towards what MS is or isn't doing to improve the test itself. Larger question pools, adaptive testing, more simulations instead of multiple choice are all steps that could be taken towards making braindumping useless and irrelevant. We shouldn't need a CCIE style hands-on lab test, why can't the company that produces the Flight Simulator GAME produce an OS simulation test? I'm going through a lot of work to get this MCSE - I want it to really mean something when I'm done.
