Police Seize Assets of TestKiller.com


7/10/2002 -- On June 6 San Antonio police seized assets of TestKiller Ltd., the company that runs the practice exam Web site TestKiller.com.

According to a police report filed with the Bexar County, Texas District Court on June 20, the raid was prompted by Microsoft, who alleged that the site was selling Microsoft certification exam questions.

In his affidavit, seizing police officer Daniel Flaharty, a detective in the Special Crimes Unit of the San Antonio Police Department, wrote that he was contacted by a representative from the anti-piracy office of Microsoft. The unnamed representative alleged to Flaharty that TestKiller Ltd. was selling Microsoft "trade secrets" in the form of questions and answers to Microsoft exams.

According to the report, Flaharty began an investigation based on Microsoft's complaint, which led to the June 6 seizure of $408,566.84 in cash as well as several phones, printers, computer equipment, software and other items from at least one location.

No charges have been filed in this investigation. Calls made to the Bexar County district attorney's office to determine whether the investigation was ongoing were not returned as of press time.

Garry L. Neale, one of Testkiller Ltd.'s owners, politely declined CertCities.com's request for an interview, referring all questions to his attorney, who is out of the country this week.

A spokesperson for Microsoft confirmed that the company was aware of the investigation but said he could not comment on it due to the legal nature of the story.

The Testkiller.com Web site has been offline since early June.

Neale is the former owner of Troy Technologies (TroyTec.com), which in December settled a civil copyright and trademark infringement lawsuit brought by certification vendor CompTIA (see "CompTIA v. TroyTec Settled; Company Pulls CompTIA-Related Products from Site, Denies Wrongdoing").

7/12/02: MCSE MCDBA CCNP CCNA Network+ says: Microsoft test suck anyway. It is not real life or test books that will help you pass the test. If you play with the software and read alittle of BOL you will pass. How many Engineers have time to read BOL? Not many. So practace test help you to focus on an area of interest. This is nothing wrong with that. If you really want to show your stuff get you CCNA.. You don't see Cisco mad about Testkiller CCNA study guide, because their test change as people take it and they change their test offen. Its not testkiller fault its microsoft.
7/12/02: Anonymous says: I read people saying that people that have bought the TestKiller papers should have to retake their exams, but what if you only bought one paper? Is it fair to make someone retake all their exams because they bought one test-prep? I know that some of you will say, "How do we, does Microsoft know that you only bought one test-prep?" My answer is "Exactly." It's not fair to make people retake all their exams if they didn't use these test-prep materials on other exams. So, what affect does this really have? I have taken 4 tests. On my own, I passed 3. I used a TestKiller paper on one, but one that is not directly related to my MCSE track. If Microsoft tells me that I have to retake all the exams. I will not like it, but I will it because I know that I can pass. CompTIA said that they would not de-cert anyone that had purchased any materials from TroyTech.com; their method of resolving this was to notify those people on TroyTech's purchasing list that the material they had was copyrighted and what TroyTech was doing, and posession of these materials was illegal. I think that is fair because eventually you will either lose your job or the truth will show. But not by de-certing people. The thing is: It's up to Microsoft. Not us.

7/12/02: Happy from LA says: I am glad to see there will be fewer paper MCSE's in the job market. I am tired of seeing people apply for a job and not knowing more then the answer is "C" This hurts everyone and makes salaries drop.
7/12/02: Concerned says: I think what alot of ppl over looked is that troytec sold out 12/19/2001, since 6/10/2002 testkillers has made $408,566.84, and I am not sure that is not all of it. That is amazing. There is 100s of these sites, alot over seas. So I am not sure how it will ever end. I know there is alot of paper mcse's trust me I work work with a couple. But until Microsoft and Comptia make a certification that is challenging they will always be around... For instance how many paper CCIE do you here of uhhhhhhh never. I think Cisco new tests are on the right track with the flash simulators. I personnel feel that Microsoft is pissed cause someone else is making money and they are not getting any of it. Yet.... If you want this madness to stop, quit complaining and arguing on this forum and write microsoft and have them make their test harder and challenging ohhh and realistic. But that is just my opinion......

I can't tell you how many people I interview monthly and most can't even figure out the little problems I throw at them in the lab.
