Microsoft Sues Testing Materials Vendor


8/17/2006 -- Microsoft has filed a federal lawsuit against testing materials vendor TestKing, alleging that the company is illegally selling the actual answers to its certification exams.

The suit, filed last week in Federal District Court in Seattle, claims that the "defendants have provided and are providing, without license or permission from Microsoft, the original copyrighted exam content from Microsoft Certification Exams."

Microsoft has always taken its certification programs seriously because it helps assure continued sales and proper support of its products. Apparently, according to the suit, TestKing is helping candidates cheat -- at Microsoft's expense.

"We guarantee that by using our Microsoft Exams training materials you will be prepared for your upcoming Microsoft Exam, and will pass on your first attempt," say claims on TestKing's site.

TestKing also operates other sites through which the company sells the infringing testing materials, according to the complaint. In fact, Web searches found several other, apparently related sites also selling similar test preparation materials.

The lawsuit claims multiple counts of copyright infringement and asks for a permanent injunction to stop TestKing from continuing to sell or distribute the materials. It also seeks damages. Additionally, Microsoft's attorneys asked the court to turn the Internet domain TestKing.com over to them.

TestKing's Web site lists a mailing address for a company named Certification Trendz Limited in the United Kingdom but no phone number, and the site does not identify the company's executives or management. Due to the inability to initially identify who runs the company, Microsoft issued what is called a "John Doe" lawsuit, with the defendants to be identified later.

On its site, TestKing claims to sell test training materials for a wide variety of different technology companies' certifications in addition to Microsoft's. Materials are also offered for products from Adobe, Apple, Checkpoint, Cisco, Citrix, Dell, IBM, HP, Symantec, Sun and Oracle. TestKing also offers preparation materials for some non-vendor certifications such as Certified Information Systems Security Professional and CompTIA A+.

12/29/07: c learning from usa says: my use of TK has been successful. it allotted me to acquire MCDST & MCP I've also purchased the entire MCSA,MCSE & MCP training material as I am aware that experience is a good teacher.I've been in IT for 13yrs and i'm always looking for new ways to learn. TK not only teaches me, but it also gives me a different way to think out different scenarious that are defined in the questions asked on MS cert tests. i'm sure bill gates and company can find better use of of his money than to WASTE time attempting to SHUT DOWN one of his possible competetitors.

TestKings acquires 'THE' actual questions given on the exams(HOW DID THIS HAPPEN IN THE FIRST PLACE) and MICROSOFT charges $125 to take the THEIR test. How and Why would Microsoft ACTUALLY be looking to shut down Testkings when in actuality, theY're being provided a study & consistent flow of clientele that is willing and able to keep MICROSOFT THE largest software company in the WORLD!!!
9/25/08: RM from Oz says: While I have not used the testking material myself, I have seen similiar material from other sites which are EXACTLY identical to the questions so good on Microsoft for exercising their legal right. I'd put some blame on MS for making the tests so easy to copy the questions in the first place, but I'd have to put more on the fool that copies the questions without changing at least some of them in some way. At least alternative sites like certkiller have similar question wording without the questions being identical to the exam. Taking an exam written in the US isn't necessarily worded the same way it would be in Australia or other countries because of different levels of technological use and particularly the way each country does business. Having similarly worded questions help make the testing unbiassed towards people from all backgrounds. Memorizing the question doesn't make a good qualified technician. Transcenders as previously mentioned and other study material are a much better way of learning what is actually required.
10/2/08: Anonymous says: Its just like in our Universities. Foreign nationals are admitted with financial packages based on GRE tests taken in their own counties. I have personally seen some that couldn't read ANY english even though they had GRE's with 90 percentile verbal scores. Talk about giant holes. In the cases I saw their 'counttrymen' faculty helped them once they got here. It erosed the value of my own degree!!!

They are a classic case of rags to riches in this third largest city of Faisalabad where every body who is any body knows every one else who is some body. I am very close to this family. Mr Shahzad Shahnawaz is son of a Retd Maj Shahnawaz from Faisalabad. They used to run a small computer college by the name of PASBAN in Faisalabad. This was at the time before the Dot Com Bust. They managed to get the Thomson Prometric Testing system in Faisalabad and from their on their fortunes turned. At the height of the Crazy Dot Com era they took thousands of dollar to get cleared exams of Microsoft,Oracle etc which was equivalent to a visa to any country in the west as the demand was very high for certification holder. Needless to say many people to get visa to the west gave them thousands of dollars to cheat their way through certification exams. Maj Shahnawaz and his daughters used to conduct the exam and it used to be hundreds of tests per month. However only after an years time Prometric cancelled their site after discovering the abuse and the duck that was laying the golden eggs was dead. However Mr.Shahzad Shahnawaz who is by education a doctor MBBS took the down turn in his fortune as a challenge. It was widely known that he has done every certification delivered through prometric at that time and became well versed with the certification exams.
7/28/09: faisalabad from faisalabad says: A few prometric operators tell of how a second monitor wire used to go out of the testing computer to adjacent rooms where they used to copy the exam questions. With the end of Prometric their fortunes had turned back again however it is their genius that they went international instead of just local operators. Mr. Shahzad went / disappeared to dubai for a couple of years and from their with some developers and some other prometric centers they launched test king. They used to have rented house and Maj Shahnawaz used to roam the city on a VESPA. With the cheating money they now have the only Red Ferrari in Faisalabad. Three or four seven series bmws, Porche cyans, latest Toyota Land Cruiser, properties in industrial estates, plazas in lahore and every city of Faisalabad. Needless to say they have billions of Rupees of wealth all in Pakistan. From a rented house they have built an 8 Kanal house in the middle of Faisalabad, the house where a dozen guards are standing outside their house. The whole city is amazed at their wealth and their sudden rise. Their are industrialist in the city who have been here for the last 50 or 60 years but their wealth is unrivalled. More interesting stuff is the Mr. Shahzad Shahnawaz does not meet any one he is married to an UZBEK woman. He preffered to marry some one who could not communicate to any one and was isolated so no one can know the source of their wealth. Any one can come and visit Faisalabad and the whole city knows where PASBAN IT Group is.
