BREAKING NEWS: "Braindump" Site Owner Sentenced


1/31/2003 -- Robert Keppel, the first "braindump" site owner to be criminally convicted for selling IT certification exam questions, was sentenced this morning in federal court to 12 months and 1 day in prison and ordered to pay $500,000 in restitution to Microsoft.

Judge Ronald Leighton in the United States District Court, Western District of Washington also ordered Keppel to three years supervised release after his prison term is served, and added a $100 "special assessment" that goes into the court's victim relief fund, a court spokesperson said.

Keppel pleaded guilty in August to a felony charge of theft of trade secrets in violation of Title 18, United States Code, Section 1832(a)(2), part of the Economic Espionage Act of 1996. The charges stemmed from the sale of Microsoft certification exam questions through Keppel's now-defunct Web sites, Cheet-Sheets.com and CheetSheets.com.

The U.S. Attorney's office had asked for an 18 month prison sentence for Keppel.

Keppel's defense attorney argued for work release or probation.

An independent attorney told CertCities.com that Keppel could serve as little as four months of his sentence, depending on factors such as "good behavior." The defense could also choose to petition the judge to reconsider the sentence.

CertCities.com is attempting to contact Microsoft and Keppel's defense attorney for reaction to this verdict.

The amount of restitution Keppel was ordered to pay is in addition to assets already forfeited by Keppel, including a 1997 Ferarri Spider, a 2001 Lexis RX300 and $56,000 seized from various bank accounts.

A spokesperson for the US Attorney's office told CertCities.com that the reason the sentence was 12 months and one day is that "[the sentence] needs to be over a year [for] a felony."

Robert Pedigo, Executive Director for the Information Technology Certification Security Council (ITCSC), an industry consortium that works to preserve the security of certification exams, said that the verdict is "good news for everyone who takes a certification test honestly and for those who create and deliver those tests. It's bad news for those who would try to profit by undermining the value of certifications."

"The members of the ITCSC [which includes Microsoft, Cisco, CompTIA, and others] believe that the important point is summed up by the conviction," he commented. "It demonstrates that the courts recognize the copyrights of intellectual property owners and that test theft and fraud in testing are now clearly criminal activities."  -B.N.

1/31/03: Bad Decision says: I noticed the big banner ad for Test King that appears throughout certcities.com. Is this a legitimate product? "Almost every question that specifies an exhibit HAS an exhibit that is almost identical to the ones in the actual exam" "Thanks, ALL of your questions were on my test" (From their reference page) I suppose it doesn't matter as long as they pay for the ads or you 'pass' the test. How can certcities.com--in clear conscience--report on this Cheet Sheets case when a cheat company like testking.com pays your salaries?
1/31/03: Anonymous says: Trade Secrets - give me a break, the content is all over the net, there is nothing secret about exam questions. He did nothing more than 100's of web sites and practice exam providers out there. Have a look at braindump questions and trancender or self-test questions, not much of a difference. I read the other day that the CEO of Self-test said "it was about time" or some other crap - hay! your next buddy. O ya right, your an "official test partner" so your safe. Sounds like the the mob to me - You pay Microsoft a licensing fee to steal their questions, so they won't go after you - maybe that's what this Robert Keppel guy should have done.

1/31/03: WHG says: I don't think this crime should be considered a felony. A misdemeanor, perhaps, but even then, I don't think this should be a crime. We have gone from Open Systems to Open Source and now we have Open Information. All information should be free on the Internet. There should be no secrets that are kept behind the closed doors of smoke-filled rooms. We the public are being bilked and hoodwinked every day. People like Robert Keppel are the real heroes that are on our side. Hey, we all need jobs too. A privileged few can afford to buy information to allow themselves to be certified so why can't the rest of us poor folks have access too? It's like some guru's inner circle excluding the majority of us from the good stuff. Everybody deserves to work. It's Microsoft that makes all the money from certification training and then asks us to upgrade every few years so they can fill their doffers with our blood, sweat and tears studying all night every day. We all are in this together. This is how we learn what we need to know to pass some exam. No more secrets! Provide access to all the secret info for all and we wouldn't be in this mess today, getting hoodwinked by the haves. Better yet, develop your psychic abilities so you can read the test-givers' minds and pass :) Sheesh! You'd think we were trying to join some high falutin Masonic Lodge with some secret incantations know only to a few! -MCSE (Masonic Control Society Elite)

1/31/03: Got My MCSE from California says: When I was studying for my MCSE I looked at braindump sites and purchase practice tests. The only difference I saw was that the braindump sites' questions were barely in English and often had incorrect or misleading answers. So I simply cut and paste the questions, deleted the answers and figured out my own answers. And I passed every exam on my first try.
1/31/03: Anonymous from Louisville, Kentucky says: It's one thing to create test situations your self and to profit from it, this is legal. To outwardly post current Microsoft exams for profit is criminal and unethical. I do not believe jail time is appropriate in this situation. The monetary penalty and supervised probation seems sufficient. Prisons should be reserved for violent offenders and predators.
